Legal Notices

Notice of all public hearings shall be published at least once each week for two successive weeks, with the first of such notices being published at least fifteen days prior to the hearing, in the official newspaper of the county and in the official newspaper of the municipality in relation to which the zoning action is taken.

The notice of hearing shall:

1) Indicate the time and place of the scheduled public hearing
2) Describe the property by street address, legal description, or map
3) Describe the nature, scope, and purpose of the proposal
4) Indicate the location and source of additional information on the proposal

ORDINANCE NO. 2024-04 OF THE CITY OF HORACE, NORTH DAKOTA

Notice is hereby given that the City Council of the City of Horace, North Dakota, at a regularly scheduled meeting on April 1, 2024, had the question of the second reading and final passage of Ordinance No. 2024-04 before them and duly adopted the same. The ordinance was entitled: AN ORDINANCE TO AMEND AND REENACT TITLE IV OF THE REVISED ORDINANCES OF 2003 OF THE CITY OF HORACE RELATING TO THE LAND USE CODE.

A certified copy of the ordinance is available for public inspection and copying at the office of the City Auditor by appointment, all days except weekends and holidays. The penalty clauses of the ordinance read as follows: 4-8.1 Violations and Penalties. Anyone who violates the provisions of this code or fails to comply with any of its requirements, upon conviction, shall be punished by a fine of no more than $1,000.00 per day. Each day that a violation continues shall constitute a separate offense.

OF THE CITY OF HORACE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HORACE, CASS
COUNTY, NORTH DAKOTA, that it is hereby found, determined, and declared to be necessary and
expedient for the City of Horace to construct an improvement in and for Water, Sewer, Storm, and
Street Improvement District No. 2023-4, for the installation of sanitary sewer mains, water mains,
storm sewers, manholes, fire hydrants, gate valves, paved streets with curb and gutter, sidewalk and
multiuse path, seeding and hydro-mulching, street lighting, and related improvements and
appurtenances, in accordance with and as described in the resolution creating said district adopted on
November 6, 2023, and the Engineer’s Report which has been prepared by the Engineer for the City
and approved by the City Council, which resolution and Engineer’s Report, together with an estimate
