Notice of all public hearings shall be published at least once each week for two successive weeks, with the first of such notices being published at least fifteen days prior to the hearing, in the official newspaper of the county and in the official newspaper of the municipality in relation to which the zoning action is taken.
The notice of hearing shall:
1) indicate the time and place of the scheduled public hearing
2) describe the property by street address, legal description, or map
3) describe the nature, scope, and purpose of the proposal
4) indicate the location and source of additional information on the proposal

RESOLUTION DECLARING WORK NECESSARY FOR AN IMPROVEMENT IN WATER, SEWER, STORM, AND STREET IMPROVEMENT DISTRICT NO. 2022-11

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HORACE, CASS COUNTY,

NORTH DAKOTA, that it is hereby found, determined, and declared to be necessary and expedient for the City of Horace to construct improvements in and for Water, Sewer, Storm, and Street Improvement District No. 2022-11 consisting of the construction of 83rd Avenue South and storm water retention system, and local improvements consisting of sanitary sewer mains and services, water mains and services, storm sewer, streets, curb and gutter, street lights, sidewalks, and all other appurtenances, contrivances, and structures used or useful in connection with the above specified improvements, in accordance with and as described in the resolution creating said district adopted March 7, 2022, and the Engineer’s Report which has been prepared by the Engineer for the City of Horace and approved by this City Council, which resolution and Engineer’s Report, together with an estimate of the probable cost of the work, are now on file in the office of the City Auditor and are open to public inspection.

BE IT FURTHER RESOLVED that the entire cost of said improvements be specially assessed against the benefited property in said improvement district in amounts proportionate to and not exceeding the benefits to be derived by them respectively from said improvements.

BE IT FURTHER RESOLVED that the owners of the property liable to be specially assessed for said improvements may file written protests against the said improvements within thirty (30) days after the first publication of this resolution, and this City Council shall at its next meeting after the expiration of said period, to-wit: On November 21, 2022, at 6:00 p.m. meet at Horace Fire Hall & Event Center, 413 Main Street, Horace, ND, for the purpose of hearing and determining the sufficiency of any protests so filed and of taking any such further action with respect to said improvements as may then be deemed necessary and expedient.

BE IT FURTHER RESOLVED that the City Auditor is hereby authorized and directed to cause this resolution, including a map of the improvement district, to be published once each week for two consecutive weeks in the official newspaper of the City of Horace, North Dakota.

 NOTICE OF CONFIRMATION OF ASSESSMENT LIST IN SEWER IMPROVEMENT DISTRICT NO. 2018-1  OF THE CITY OF HORACE, NORTH DAKOTA  

Notice is hereby given that the Special Assessment Commission of the City of Horace, North Dakota has confirmed the Special Assessment List for Sewer Improvement District No. 2018-1; 

Notice is further given that said confirmed list has been filed with the City Auditor, is open for public inspection, and the City Council will call a special meeting to conduct a public hearing on said list at 6:00 p.m. on Monday, October 10, 2022, at the Horace Fire Hall, 413 Main Street, Horace, ND, to act upon said list; 

Notice is further given that any person aggrieved may appeal from the action of the Special Assessment Commission by filing with the City Auditor prior to the hearing a written notice of appeal stating thereon the grounds upon which the appeal is based. Any person having filed such a written notice may appear before the City Council and present his/her reasons why the action of the Special Assessment Commission should not be confirmed.
